Employment Law Weekly News Update

In this edition:

• An ET finds the dismissal of a bus driver for failing a random drug test to be unfair because the employer had ignored the results of 2 subsequent private tests which showed no evidence of cocaine.
• The Government has published a framework to support employers to voluntarily report on disability, mental health and wellbeing in the workplace.
• The BEIS has published updated guidance on calculating the NMW/NLW to include advice on unpaid work trials as part of a recruitment process to help decide whether the individual has the skills for the job.
• A survey by Insurance2go found that 61% of people use a personal device (PDA) to answer work emails or conduct work tasks while out of the workplace, but 41% were not aware of data protection rules that apply.
